OFW Law Trade War Update: Temporary Suspension of the New Tariffs for all USMCA-Compliant Goods

From AFOA’s General Counsel (Olsson Frank Weeda) on March 6, 2025.

The White House announced today that effective 12:01 a.m. EST March 7, the 25% IEEPA-based tariffs on Canadian- and Mexican-origin goods (10% on Canadian-origin energy products) will be suspended for all USMCA-compliant goods (all goods which meet USMCA origin requirements) until April 2 (the date on which President Trump has stated that “reciprocal tariffs” will go into effect). These IEEPA-based tariffs went into effect as of 12:01 a.m. EST on March 4.  This development follows the announcement yesterday of a more limited suspension for USMCA-compliant automobiles.

In addition to the temporary suspension of the new tariffs, the Executive Orders lower the tariff rate on potash from Canada and Mexico that does not meet USMCA origin requirements from 25% to 10%.

Canada has not announced a similar suspension of its retaliatory tariffs on U.S.-origin goods which went effect on 12:01 a.m. EST March 7.  President Sheinbaum of Mexico, however, stated today that she will not be announcing retaliatory tariffs on the U.S. on March 9 as had been previously scheduled.

The increase in the IEEPA-based tariffs from 10% to 20% on Chinese- and Hong Kong-origin products that also went into effect as of 12:01 a.m. EST on March 4, remains unchanged (and we do not anticipate a similar suspension of that increase).  China’s retaliatory tariffs on U.S.-origin products also remain unchanged.
